What’s happened?

ASIC has published a regulatory guide on sustainability reporting. It’s called Regulatory Guide 280 Sustainability Reporting 

Who should know about this?

Anyone required to prepare a sustainability report containing climate-related financial information under Chapter 2M of the Corporations Act 2001. This may include public and private companies, registered schemes, registrable superannuation entities, and retail corporate collective investment vehicles, who meet the relevant size thresholds.

What is covered?

ASIC has issued guidance on how ASIC interprets the new Sustainability Reporting requirements in the Corporations Act 2001. This includes guidance on:

  • determining who must prepare a sustainability report under the Corporations Act,

  • the content required in the sustainability report,

  • disclosing sustainability-related financial information outside the sustainability report (such as in disclosure documents and product disclosure statements),

  • ASIC’s administration of the sustainability reporting requirements

ASIC have also issued information about their ‘Pragmatic and proportionate’ approach to enforcement of sustainability reporting requirements.

Finally, ASIC has will now also allow stapled entities to prepare a consolidated sustainability report for the stapled group. Further relief applications will be considered.
