Synopsis

Transfer Pricing is consistently the number one international tax issue facing multinational businesses. This is especially true in Singapore, often the location of global and regional hubs, which combined with its low taxation regime, is often seen by other fiscal authorities as a jurisdiction to which multinationals profit shift. As such, international related party dealings with Singapore need to be rigorously documented and justified as being substantive, commercial and arm’s length.

Singapore has also recently, along with many other countries worldwide, adopted the BEPS recommendations including Country by Country Reporting, (“CbCR”). CbCR in Singapore will have a significant impact on documentation and reporting requirements of those companies which are classified as Significant Global Entities (“SGE’s”). This year is the first year such a regime applies to Singaporean SGE’s and as such will provide its own challenges in meeting the onerous requirements in a timely and penalty free manner.
